Current Cannabis Laws

The British Virgin Islands present a frustrating picture for cannabis reform advocates. The House of Assembly passed a Cannabis Licensing Act that would establish a commercial medical cannabis sector — covering cultivation, retail, and manufacturing. But Governor Augustus Jaspert refused to give the bill Royal Assent, effectively blocking it.

The government found a workaround via existing health legislation, allowing the Minister for Health to create regulations for medical practitioners to prescribe cannabis. But this is a narrow pathway, not a full commercial framework.

Recreational cannabis remains fully illegal. As a British Overseas Territory, the BVI’s reform efforts face an additional layer of approval from London.

For Tourists

The BVI has no legal cannabis access for tourists. Don’t bring it from the USVI across the water — even though the US and British Virgin Islands are neighbors, they’re separate jurisdictions with very different laws.

The sailing, beaches, and rum are world-class. The cannabis situation is not.
