Why Bonaire isn’t Amsterdam
Bonaire is a special municipality of the Netherlands and one of the BES islands (with Sint Eustatius and Saba), making it a direct part of the country since 2010. That sounds like Dutch law should apply in full, but the BES islands have their own separate legal framework.
The Dutch Opium Act does not apply in Bonaire. Instead, the Opium Act BES (Opiumwet BES) applies, which is a stricter Caribbean version of the same law. The Dutch coffee shop tolerance is a prosecutorial guideline that operates only in the European Netherlands. There is no equivalent guideline in the BES islands. The Dutch Bedrocan medical cannabis program also stops at the BES boundary.
The net result is that Bonaire is a piece of the Netherlands where cannabis is more strictly illegal than in mainland Netherlands. CBD products are also banned under the same act, which catches out tourists who legally use CBD at home.
What tourists actually face
Bonaire is a small island with active policing and a tight diving and ecotourism focus. Enforcement is real.
- Flamingo International Airport uses drug screening procedures on arrival and departure.
- Possession penalty. Up to 4 years imprisonment. No tolerance threshold for personal-use amounts.
- CBD products. Banned. Do not assume your travel CBD is legal here just because it’s legal in the European Netherlands or the US.
- Medical cannabis. The Dutch Bedrocan program does not extend to Bonaire. A Dutch medical card has no legal effect on the island.
- Cruise passengers. Bonaire’s cruise port enforces the same law. Caught with cannabis, you risk denied reboarding and local charges.
Bonaire is one of the best diving destinations in the Caribbean. Come for the reef. Leave the cannabis at home.
